1. Legal Notice

Paws & Stays is operated jointly by Ales Skarda and Alexandr Vondruska, currently acting as private individuals.

No Swiss enterprise identification number (UID) or VAT number has yet been assigned. These details will be updated if the operating structure changes, including a future conversion to a GmbH.

Purpose of the platform

Paws & Stays provides information and community features relating to dog-friendly accommodation, dining, walks, veterinary clinics, training, travel services and related products. Listings and community contributions may be supplied by independent businesses or users. Unless expressly stated otherwise, Paws & Stays is not the operator of the listed venue and is not a party to a reservation or service contract between a visitor and a third party.

Applicable law

Swiss law applies, without prejudice to mandatory consumer, data-protection and conflict-of-law provisions. To the extent legally permitted, the courts competent for Niederwil AG, Canton Aargau, Switzerland, have jurisdiction. Any mandatory statutory place of jurisdiction remains unaffected.

2. Privacy Policy

This policy explains how personal data is processed in connection with pawsandstays.ch and its related services. The Swiss Federal Act on Data Protection (FADP/nDSG) applies. The EU or EEA General Data Protection Regulation (GDPR) may additionally apply where its territorial requirements are met.

2.1 Controller

Ales Skarda and Alexandr Vondruska are jointly responsible for the processing described here. Privacy requests may be sent to info@pawsandstays.ch or to the postal address stated above.

2.2 Data we may collect

  • Account and profile data: name, username, email address, encrypted password, profile image, dog information, preferences and account settings.
  • Contact and form data: messages, enquiries, support requests and information entered into registration, contact or submission forms.
  • Listings, advertising and order data: business name, contact person, address, links, package selected, campaign instructions, supplied media, approval history, invoices and payment status.
  • Payment information: transaction confirmation, amount, method and reference. Card or TWINT providers may process payment credentials directly; Paws & Stays does not intend to store complete card numbers.
  • Community content: posts, reviews, comments, photographs, reactions, reports and locations voluntarily submitted by users.
  • Technical and usage data: IP address, timestamps, browser and device information, referring page, pages viewed, security events, error logs and cookie identifiers.
  • Location data: a place selected or submitted by a user and, only where a feature requests and permission allows it, approximate or device location.

2.3 Purposes and legal grounds

Data is processed to operate accounts and community features; respond to enquiries; review and publish listings; fulfil advertising orders; process and document payments; prevent fraud and misuse; secure, diagnose and improve the website; measure reach; comply with legal duties; and establish or defend legal claims.

Under the GDPR, where applicable, the relevant bases may be performance of a contract or steps requested before a contract, compliance with legal obligations, legitimate interests in operating and protecting the platform, and consent for optional analytics, marketing or other activities where consent is required. Consent may be withdrawn for the future at any time. Under Swiss law, processing is carried out in accordance with the principles of lawfulness, good faith, transparency, proportionality, purpose limitation and data security.

2.4 Sources and recipients

Most information is obtained directly from users, customers and listed businesses. Technical information is generated when the website is used. Information may also be received from a payment provider, authentication service, publicly available business source or a person authorised to act for a business.

Access is limited to the operators and service providers that need the information for their work. Depending on which functions are enabled, providers may include Infomaniak for hosting and email; WordPress; Elementor; Automattic or Jetpack; BuddyBoss; GeoDirectory; WPForms or Fluent Forms; booking and calendar tools; Google services such as Maps, Analytics or Search Console; social-media platforms; mailing providers; and providers processing card, bank-transfer or TWINT payments. Mention of a service does not mean that every service processes every visitor’s data. Providers process only the information relevant to enabled functions.

Information may also be disclosed when required by law, to protect users or the platform, in connection with professional advice, or as part of a lawful organisational transfer. Personal data is not sold.

2.5 International transfers

Some providers may process data outside Switzerland or the EEA. Where the destination is not recognised as providing adequate protection, appropriate safeguards are used where required, such as recognised standard contractual clauses, together with supplementary measures where appropriate. Statutory exceptions may apply in individual cases.

2.6 Retention

Data is retained only for as long as necessary for the relevant purpose, legitimate documentation and security needs, or legal obligations. Account data is normally retained while an account remains active and for a limited period afterwards. Enquiries and moderation records are retained according to their relevance and potential follow-up. Advertising, contractual and accounting records may be retained for the statutory period applicable in Switzerland. Backups and security logs may be deleted on separate technical cycles. Data may be retained longer where a dispute, legal hold or obligation requires it.

2.7 Security

Reasonable organisational and technical safeguards are used, including access controls, updates, backups, encrypted transmission where supported and measures against unauthorised access. No internet transmission or storage system can be guaranteed to be completely secure. Users should protect their credentials and notify us of suspected misuse.

2.8 Your rights

Subject to the conditions and limits of applicable law, individuals may request information and access, correction, deletion, restriction, objection, data portability or withdrawal of consent. Requests should identify the account or data concerned. Reasonable proof of identity may be required to protect other users. Requests can be sent to info@pawsandstays.ch.

Individuals may contact the Swiss Federal Data Protection and Information Commissioner (FDPIC). Where the GDPR applies, they may also complain to the competent supervisory authority in the EEA. Exercising a right does not affect processing already lawfully carried out.

2.9 Children and external links

The platform is not designed for children to enter commercial contracts independently. A parent or guardian should supervise use by minors and provide any legally required consent. External websites have their own privacy practices; users should review them before providing information.

3. Cookie Policy

Cookies and similar technologies store or retrieve information on a device. The website may use the following categories:

  • Strictly necessary: login, session, security, load balancing and requested functionality.
  • Preferences: language, display and other choices.
  • Analytics: aggregated or identifiable information about use and performance.
  • Marketing: campaign measurement, advertising or social-media attribution.
  • Embedded content: maps, videos, social posts or other third-party features that may set their own cookies.

Where consent is required, non-essential technologies should be activated only after the relevant choice. A decision can be changed through the cookie-consent tool when it is displayed. If no persistent settings control is visible, users may clear or block cookies in their browser or contact us. Blocking necessary cookies may prevent requested functions from working. Consent withdrawal operates for the future and does not make earlier lawful processing invalid.

Browser controls: Most browsers allow cookies to be viewed, blocked or deleted. Embedded third-party content may remain unavailable until the corresponding category is accepted.

4. Advertising Terms

These conditions apply to Free Listings, Featured Profiles, Social Spotlights, Partner Launch campaigns and related promotional work. Submitting a request does not itself guarantee acceptance. A contract is formed when Paws & Stays confirms an order or begins the agreed work.

4.1 Packages, prices and payment

The description and price displayed on the promotion order page at the time of ordering, together with any individually accepted written quotation, determine the purchased scope. Prices are stated in Swiss francs (CHF) unless indicated otherwise. Payment may be made by bank transfer, card or TWINT where that method is offered. Work normally starts after payment is received and all necessary materials and approvals are complete. Taxes or charges required by law will be shown where applicable.

4.2 Customer materials and approval

The customer must provide accurate business information, destination links, text, logos, photographs and campaign instructions in usable quality and on time. The customer confirms that it owns or has permission to use and license all supplied material, including identifiable people, trademarks and music. Paws & Stays may request evidence of permission, edits or replacement material.

Content may be rejected, paused or removed where it is unlawful, misleading, unsafe, discriminatory, infringing, technically unsuitable, inconsistent with the dog-friendly purpose of the platform or reasonably likely to damage users or the Paws & Stays brand. Paid or sponsored material may be labelled as advertising, sponsored or partnership content. Publication does not constitute an endorsement or verification of every customer claim.

4.3 Expected delivery schedule

These are planning estimates, not guaranteed deadlines, unless a specific date is expressly accepted in writing. Delays in materials, approvals, payment, platform availability or third-party review extend the schedule accordingly.

4.4 Duration, cancellation and rescheduling

  • There is no automatic renewal unless the customer expressly accepts it during ordering or in a separate agreement.
  • A Free Listing may be removed on request, subject to reasonable processing time and legal retention requirements.
  • A Featured Profile runs for the purchased period and then ends unless renewed.
  • A Social Spotlight may be cancelled without a service charge before creative work begins. Once work has started, documented work already performed may be charged. After publication, no refund is normally due except where mandatory law requires it or Paws & Stays fails to provide the agreed service.
  • Partner Launch has a fixed three-month term. Early termination by the customer normally does not create a pro-rata refund, subject to mandatory rights and any individual written agreement.
  • One rescheduling request may be made without an additional fee if received at least three business days before scheduled publication. A new date remains subject to availability.

Any mandatory consumer cancellation, warranty or refund right remains unaffected. Paws & Stays may terminate or suspend an order for material breach, non-payment, unlawful content or significant risk, after reasonable notice where appropriate.

4.5 Results and reporting

Audience behaviour depends on many factors. Paws & Stays does not guarantee a minimum number of impressions, followers, clicks, enquiries, bookings, sales or search-engine positions unless a written order expressly states a measurable commitment. Any statistics are based on the tools reasonably available and may be affected by privacy settings, blockers and platform reporting methods.

5. Intellectual Property & Takedown

Paws & Stays branding, original layout, editorial text and original media are protected by applicable intellectual-property laws. Except where permitted by law or authorised in writing, they may not be copied, republished or used commercially.

Customers and community users retain ownership of their content. By submitting content for publication, they grant Paws & Stays a non-exclusive, worldwide, royalty-free licence for the period reasonably needed to host, reproduce, resize, format, translate where agreed, display, distribute and promote that content through the website and agreed social channels. This licence is limited to operating and promoting the platform, the listing, the community contribution or the purchased campaign.

A person who believes that content infringes copyright, trademark, privacy or another right should email info@pawsandstays.ch with the URL, description, proof of rights and requested action. Content may be restricted while a report is reviewed. Knowingly false reports are prohibited.

6. Liability, Availability & Third Parties

Information about venues, routes, opening hours, rules, prices, hazards and services may change. Users must verify important information directly with the relevant provider or authority and make their own safety assessment, especially for outdoor activities, animal health and emergencies. Website content is not veterinary, medical, legal or travel advice.

Third-party listings, links and embedded services remain the responsibility of their operators. Paws & Stays is not responsible for an independent provider’s performance, availability, terms or privacy practices. The website may be interrupted for maintenance, security, technical failure or circumstances outside reasonable control.

To the extent permitted by mandatory Swiss law, liability for indirect or consequential loss is excluded and other liability is limited to reasonably foreseeable direct loss caused by a breach attributable to Paws & Stays. Nothing excludes or limits liability where exclusion is prohibited, including liability arising from intent or gross negligence where applicable.

Neither party is responsible for delay caused by events beyond reasonable control, including major network failures, natural events, governmental measures, platform outages or similar force-majeure circumstances. Invalid provisions are replaced, to the extent possible, by a valid provision closest to their purpose; the remaining provisions continue to apply. An accepted order or individual written agreement takes priority where it expressly differs from these general terms.

7. Community Guidelines

Community participation should help people discover safe, welcoming places and exchange genuine experience. Users are responsible for what they submit and must:

  • communicate respectfully and avoid harassment, threats, hate speech, discrimination or deliberate humiliation;
  • post honest reviews and accurate place information based on genuine experience;
  • avoid spam, scams, undisclosed commercial promotion, impersonation and manipulation of ratings;
  • respect copyright, trademarks, privacy and image rights, including obtaining consent before sharing identifiable people;
  • avoid publishing sensitive personal information, unsafe instructions, malware, illegal material or content that endangers people or animals;
  • use location information responsibly and avoid exposing private residences or protected locations without justification.

Paws & Stays may investigate reports, reduce visibility, edit formatting, remove content, restrict features or suspend accounts where reasonably necessary for safety, legal compliance or enforcement. Serious matters may be preserved or reported to competent authorities where legally permitted or required. Moderation decisions may consider context, severity, repetition and risk.

Reports and requests for review may be sent to info@pawsandstays.ch with the relevant link and explanation. A review does not guarantee restoration. Users may close their accounts or request removal of their own content, subject to the rights of others and legal retention obligations.

8. Changes & Contact

These terms may be updated to reflect new functions, providers, prices or legal requirements. The current version and effective date will be published on this page. Material contractual changes will not retroactively alter a confirmed order unless agreed or required by law.
